ASC Modification Help

hi i need help i haev a fixed rate till 01/01/2009 it turn adjustable at 02/01/2009 our rate is 8.99 and could go up 3% the first year which would make my payments 300-400.00 more after the first year it could go up to 6% so i called asc as i asked about teh freeze rate they told us we di dnot qualify maybe ause our credit got better since we got he mortgage which i can not believe anyway they tol dme i can not do a modification till 12/10/2009 what i did not ask is if i have to be late as i never been late or will not miss a payment ever. please help me do this sandy
