Default forclosure loan modification with asc

hello we have been battling forclosure for the past 21/2 years since march 2006 we had hired u.s loss mitigations to help us with the lenders that was august of 2006 i lost my dad in sept 2006 in which we had to pay for the funeral which put us in a deeper hole then finally in oct 2006 they finally neg a deal they wanted $5,600.00 dollars down by the end of oct which was only about 10 days to gather up this money we were unable to make it so we started all over again which took about another 3 to 4 maybe longer but at that time we owed about $20,000.00 on the loan they put us on a repayment plan in march of 2007 my husband got hurt and was out of work till june of 2007 they gave us another chance with a 3 month repayment plan which they wanted $9,600.00 down which we payed then it was $2,500.00 for the next 2 months we payed that which was close to $15,000.00 we i thought finally its over they were giving us a loan mod which they would put the rest for the life of loan which is 30 years they had told us and u.s loss mitigation that there were no more downpayments then we got the documents in sept of 2007 and they wanted another $8,000.00 for the attorney fees in 10 days which we were done founded we used everything we had so i called asc and they said if we dont pay it the house will be auctioned off so i called u.s loss mitigation again and they tryed but the neg who was working on our behalf left the company so i would have to pay them again so we figured thats it its all over then we couldnt let them take the house thats the only thing we had left so i called again and they agreeded to put us on a forbearence plan for 3 months dec 2007 thru feb we payed the first 2 missed the last 1 feb 2008 i called them again to see if they would put us on another repayment plan first they said that the investors what $12,000.00 by the end of that would be it but that was a different department i then was connected to asc loss mitigation they said to send income and expenses and hardship which i did that was on may 1st called every week then lat week they didnt 2 letters and check stubs i faxed twice and called monay june 2nd and they still said they didnt get them so i will send again my husband ha sa really good job now plus we moved fromupstairs to down stairs so we could rent that out that is how bad we want to keep our house but i think its to late we owe now about $45,000 in back payments not sure if that includes lawyer fee even if they give us a chance there going to want alot of money down we even are filing chapter 7 so all we have is the mortgage is there any way they might not want a large payment i read some banks dont ask or they even give you a 31 year loan instead of 30 this is a great site thank you cathy
