Default Appraisal Fraud

Two years ago I refinanced my house. The Mortgage Broker got the Loan done even though I was not sure the house would appraise for enough, it did. Now I have found out that the Appraisal was $75000 higher than the house was worth. At the time I thought it was a 90% LTV, loan amount of $328000, Appraisal at $365000. Now the house appraises at $282000, and should have never gone over $290000/$300000 according to the new Appraiser, we owe $323000, making it upside down. The 2 year ARM came due February 1, 2008, adjusted to 12.25%. I would like to sue. There is not a lot of talk about Appraisal Fraud, any advice? Thanks, Sammy
