Default Dont know what to do!! (CitiRes mod pending)

I was on a repayment plan with Citi residential for almost a year, I had only about 3 more months left & then fell behind again in January. The speacialist I am working with (Audrey whom I spoke to last in February as I have not been able to reach her since) forwarded my loan for review for a possible modification in February. I sent in the finacial package and hardship letter at the end of February. After several calls they stated they had not received it. Finally in mid March they acknowledged receipt. I have been "pestering" them at least once a week after that & every time I call they tell me my fle is still in review.. When I originally purchased this property in 04, I had excellent credit, however due to some difficult situations my credit has since seriously deteriorated. My loan is due to adjust in 09 and it would then be even harder to meet the monthly pmt. I was served with a court order yesterday from Capital One, and have been thinking of filing Chapter 7, however I think that if I do this prior to my Modification decision, I will not be able to keep my house. Does anyone know about this? My court is May 9, so I am running out of time and I really cant afford for my wages to be garnished from capital one.. Last time I spoke to Citi Residentail they stated the foreclosusre proceedings were being stalled until there was a decision on my loan mod. I have some $ in my bank account which I was holding in case CitiResidential required me to make a down payment on my loan... But now I am afraid that if a judgement is entered they can take this $. Any suggestions? To make matters worse my RE taxes were sold & I was planning on redeeming them with my tax return. Does anyone know how this comes into play with the mod. procedue? Can they deny it because of this? Please any suggestions or help would be greatly appreciated..
