Default IndyMac Loan MOds back in July

Hello all ( and Cat)Cat: just spoke to Indymac again...... They still claim that they are 45-60 days behind in processing all mods. And mine should update soon. Now mind you; I send mine back to them in July. My account is still not updated and they are still reporting past due to all three credit agencies. As of August 1st, I should not be past due. Do you think I should hire an attorney? They are bound to honor this mod, right?
