Default Letter to Attorney General

Does anyone have a direct fax number for ASC/Wells Fargo/HSBC Loss Mitigation, Home Retention or Modification departments? Below is my story: Attorney General: I am writing you today because I need some direction on how to file a complaint/class-action lawsuit against the above-mentioned. Some background: I have lived in my home for 22 years. In 2002, I purchased a business and had a small business loan. In 2005, my accountant suggested I combine my 1st and small business loan into a 2-year interest only loan to save me some money, which I did. In 2006, I took out an equity loan for home repairs - house is 20 years old and needs a roof, air condintioner, etc. In late 2006, I lost my business and was out of work for 8 months. In June 2007, I finally accepted a lesser paying position with the hopes of a promotion. In the meantime, my interest has reset. I can't refinance because I have a prepayment penalty with HSBC, the 2nd. My mom had offered to help me refinance but HSBC would not work with me and were down right mean and hurtful ("We are a big company, etc.") House prices plummet - no escape now. Tried a loan mod with ASC and was denied. Filed Chapter 13 days before foreclosure - 1st and 2nd outside of plan. I was told to make my payments directly to the lenders. July payment sent to ASC and HSBC. Receive a letter from Wells Fargo, they have no idea who I am and request additional information. I sent the letter back with the additional information and the check - did the same in August and September. Thursday, I get a Motion For Relief From The Automatic Stay for nonpayment of mortgage to ASC/HSBC. I was told my investor was Wells Fargo (ASC had forwarded my July payment to them, hence the letter from them) and what has happened to my 3 payments - now it's HSBC? What is a girl suppose to do? I have a call in to my bk attorney but once they make their one court appearance, they pretty much fall off the face of the earth. I am furious with these servicers/investors/predators with their prepayment penalties, RESPA, TILA violations, outrageous interest rates and their lack of help. No one bothered to see if I qualified for a loan when it reset to 12%. I was setup to fail and someone needs to be held accountable besides me. Also, ASC has kindly added an additional $38,058.92 to my loan for charges. I want to pay back my loans but I need a loan I can afford. I have an appointment with NACA on the 30th of this month to see if they can intervene for me. If that doesn't work, then I will have to pay another attorney to fight this with me. I know I am not alone in this battle, just go to the Internet and read about these lenders and the havoc they have created with thier greed. Thank you for your anticipated help. Enc.
