My Lender accepts my payment committment...is the forclosure complaint retracted? We were served with a complaint of foreclosure on 4/28. We contacted the lender and made payment arrangements to catch up on the balance owed. The payment will be made on 5/30. According to the summons, if we do not respond within 28 days of being served a judgment will be given the lender by default. Our lender assures us over the phone that the foreclosure has been "retracted", but we have not been able to get her to say that in writing. I am afraid that if we do not go ahead and provide an answer to the lenders attorney...that arrangements have been made to pay the balance, then we will look like we defaulted on the loan. The lender will have in effect "stolen" our house because we assumed the foreclosure was retracted based on their verbal word. Is this possible? Should we go ahead and provide an answer to the lenders lawyer, even if they say it is resolved.? Any insight provided will be greatly appreciated. |
