Need Help With Bank Of America Modification I got a loan last 8/07 with Bank of America (BOA). There was a Broker recommended by my Realtor. I was told by Broker I was getting a Fannie Mae Expanded Approval with Timely Payments Reward which was 5% down, low closing and low interest rate. This sounded great to me. Then the Broker told me they needed 10% or more and 7.5% interest. I told her I would put down 10% and no more than 7.5%. BOA and Broker told me loan was proceeding.was going along fine. The day before closing I asked Kansas City Title Co. for a HUD-1 and loan documents twice. She refused and said BOA was changing documents. I call closing morning and Closer told me they were not ready. I told her I had to see something. She said no. Closer and Broker both told me that AM that I needed to bring in $500 extra for the seller who refused. I told them no. There was nothing in writing. Broker said BOA said that if I did not bring in the money BOA would not approve my loan. I thought that was a threat and illegal. Broker said to do what BOA asks. I felt threatened and wanted the house so I felt I had no alternative but to bring $500 to closing. Half-way to closing at 1:00 p the closer rescheduled to 3:00 pm. I went back home. I was having a panic attack which I take meds for. I went in at 3:00 and at 3:30 pm closing started. Closer was flipping pages so fast without explanation my head was spinning. There were no fannie mae documents and I told her I was supposed to have fannie mae EA TPR loan. She called BOA and they faxed over a blank rider (she would not call BOA back) and a Addendum to Note which I did not notice until later was back-dated to 8/7/07 but stamped at bottom 8/10/07 which is invalid. All the documents had incorrect address and I asked closer to redo and she refused. She crossed out and address was still wrong and recorded that way. Closer gave me unsigned copies and I asked for signed and she refused stating she did not have time. I signed the documents under duress. I went out to my car and cried. I called BOA several times telling them how upset and angry I was at being taken advantage of and being threatened and asking them why my interest rate went up to 8.25% and the closing costs were $3,454 and I ended up paying $5,325. January 7, 2008 BOA mortgage sent me 4 applications and 2 fannie mae underwriting findings. WHAT A SHOCK. I thought this was a predatory lending loan. My income was intentionally inflated $300. BOA said they verified my income but they did not because I have been with them 15 years and have had 2 direct deposits and they know exactly what I earn. My address on the forms was falsified. My name was misspelled twice on the forms. I had reserves on the Underwring findings which I looked up and it says you are an investor. The loan application at closing was back-dated to 6/27/07 and unsigned by Broker which is invalid and I did not notice at closing. Now I find out I do not have a Fannie Mae loan and the documents I signed at closing are fraudulent and invalid. Fannie Mae cannot find a loan for me. I think that is why the 2 documents were not at closing. I think boa put in for a FM loan but did not close the loan. BOA underwriting declined my loan on 6/27/07 and I never knew because I never signed or saw the app. Then they upped all the terms on another app. BOA gave me a loan without verifing my ability to repay the loan. I am behind 2 payments and BOA will not work with me. I have called hope now twice and they spoke with BOA & still will not work with me. I have called OFHEO and they told me after looking at documents it was a fraud case. I have called 25 lawyers and they will not take the case. Said it takes too long. I need some help. I feel so ashamed humilated and betrayed by BOA after being with them so long. It has hurt me very bad. Please help. thanks for listening. Cheryl |
