Default Never Give Up !!!

My home had already been foreclosed on & I was facing a forceable detainer hearing tommorrow (4-16-08). The mortgage company that I originally signed with no longer has my mortgage (Ameriquest). Just about the time the foreclosure was in court Citi Residential bought all mortgages from Ameriquest. The foreclosure papers had Duestche Banks name on them also. I got on the computer & pulled the bank up & sent an email to every email address I could find with a letter telling my story attached to it. Then I done the same thing with the fax, I sent my letter to every number I could find from New York to California. I recieved several phone calls in response & finally I got a phone number to a man at the bank that had a number for a person a Citi Residential that could possibly help me. So I contacted Kirk Christianson at Citi Residential's R.E.O. department (he is in charge of the houses the company now owns due to foreclosure and explained to him the details of how it ended up in foreclosure & how long we had had the house & also that the house was not worth what they had it listed for or what they had loaned on it due to the overapprasial. He said he would talk to the V.P. and see if anything could be done. In the meantime I requested a copy of all documents and disclosures and any paperwork that the mortgage company had pertaining to my loan. I have been on the computer everyday looking and reading on the laws & regulations that pertain to mortgages & loans & looking for an attorney. After recieving all of the papers I went through them 1 by 1 with a highlighter marking anything I thought to be inaccurate. Just a couple of things I found were the apprasial obtained by Ameriquest was over 2 times the actual market value, my actual mortgage papers say home equity but all of the other papers say refinance, on the HUD-1 it said we recieved xxx amount of cash out & the other paperwork it said we recieved a different amount of cash out like $5,000 different. We recieved no Good Faith Estimate, which you are supposed to recieve within 3 days of the lender recieving your loan app. But I never filled out a loan app. the Ameriquest Rep. did & put the loan in my name using my husbands income. I am a homemaker since 2002 with no income. Talking to Mr. Christianson several times I was not sure if Citi Residential was going to do anything. So I started pointing out all of the inaccurate information & things that had been done by Ameriquest to get this loan to go through & I told them that I didn't want to cause them any problems but before I moved out of my home & let them have it I would be contacting the mortgage fraud department of the F.B.I. I think it was on one of Mr. Rosenbach's blog's about the last thing that they want is to have the Federal Gov. being brought into it. No telling what else that would open them up for. This morning I called Mr. Christianson at Citi Residential & he put me on hold while he got the final word from upstairs. He came back on the line & said they have decided to work with me and establish a new loan. I just started crying & thanking Mr. Christianson. This is the only person out of all the personell that I have talked to from any of these companies that has taken the time to help me & get something done. This is not even his department 2 days ago I called & left a message with his secratary & told her what my call was pertaining to (a loan mod. or new loan) and she said are you sure it is Kirk Christianson because he doesn't do that. I said I know he is in the REO Dept. but he is talking to people for me to get this done. Yesterday when I called she said you were right I am sorry I questioned you because he usually doesn't handle that type of thing. The sad part is Mr. Christianson informed me that he is leaving the company Friday. He put me on 3 way with the people that would be handling this for me just to make sure it was all understood by everyone. He also gave me the names & numbers of the people who would be contacting me. I wished I could do something nice for this man as nice as he has done for me. They canceled the forceable detainer hearing & I am staying in my home.Never ever give up pull every string that you can . Thanks, Lesli Anders*
