I live in jacksonville, FL. My goal is a re-structured loan where my 9 delinquent payments are put on the back of the loan. I purchased the home in May 2006. VERY creative financing. We bought more than we could afford. We moved into the home in March 2005. I was supposed to go to work before the first payment was due. However, Apr 1, 2005, we had a family tragedy. Our daughter in law had a premature baby; the baby's fine, but the mom has been hospitalized ever since (YES, OVER # YRS!) I'll not bore anyone with the details, but it's been a true tragedy. Anyway, we made the payments just fine until Sep 2007. Because of legal expenses relating to our grandson's custody, we got behind. We are 9 behind. We got the mortgage from Paragon Home Mtg; before the first payment it was sold to Advantor Capital; then we were notified that ocwen was our servicer. On Feb 21, 2008, we were served with a Notice of Lis Pendens. After several hundred hours of being on hold, and talking to India I finally made some headway and arranged a Forbearance Agreement with two regular payments, and then payemnts of 2400. Our regular payment was 2180. Welll, they never sent the Forbearance Papers until after April 1, even though I bothered them everyday about it. They wanted me to sign the papers dating Feb 28, on April 3. I called them about it, and said I wanted new paperwork so it would be legal. Well, the sent the papers, and it was totally different from the first set. I said I would never sue or complain about them. Stupidly I signed and faxed it back. I was blackmailed and forced into signing it because the said if I didn't; the sheriff would be at my dorr within 48 hours; that nothing else had to be done because they already did the Les Pendens thing. In the crossmail then, I got a letter saying they were closing my escrow acct. and my forbearance paymments would be 1990, and I was responsible for my own ins. Then they called and said they made a mistake and my two forbearance payments were 2600. I signed for 1900. I had already sent the payment by money order, and on the same day got a letter saying my rate was due for rest, and as of Jul 1, it would be 11.25%. Of course they say they got the first forbearance payment, but they did not get the second one. By the way, I answered the Lis Pendens thing within the 20 days by asking for ahearing because they put a Lost Note Affidavit and I knew that was a lie. I've never heard of HSBS Bank, or Nomura Home Equity........this is before I saw this site--it just didn't make sense to me that they lost a note and I didn't even know who my mortgage company was. After I found the siite, I looked for my settlement papers for TIL violations and other stuff, and read that MERS is my mortgage people. What the hell? My question is this: somewhere on one of these sites, there is a sample request to be sent to Ocwen, or the mortgage company asking fo copies of settlement papers, note, mortgage, master logs, payment history, etc. It's almost like the QWR sample here, but it asks for additional things. I'm blind from trying to find it. Does anyone know what all I'm suppose to ask for?" I've spent so many hours trying to get through to Ocwen, and I've sent 7 requests for settlement papers, etc. They ignored them and said they were just lost in the sysytem, so now I'm going to do it by certified mail with a copy to all the emaiol addresses provided by this site. But will sending it to Ocwen do any good, or do I need to find out who my mortgage company really is. Ocwen refuses to say. Can anyone lead me in the right direction? So sorry for the typos, but I'm upset and crying right now because I'm so frustrated about not finading the sample. I can't lose my house; I just lost my grandson. Thank you, I really am broke and blue. Well, I've never heard aback from the court about granting or denying a hearing.
