Please someone give me some advice to deal with this issue. :(In 2004 my now ex husband and I got a 2 mortgage (home equity Revolving loan). In 2005 we got divorced. In 2006 I had to claim bankruptcy due to the loss of income from my ex. When I filed bankruptcy I did reaffirm the 2nd mortgage. Here is the letter I sent F&M bank: August 20, 2008Dear Mary,In regard to the following loan 07202347683-1. I have faxed you my bankruptcy papers to show that I did reaffirm my mortgage with F&M bank, since it was a secured debt on my property of 24 years. After finding out yesterday that I had lost the house. I got the bankruptcy papers and went thru them and it didn’t make sense to me when I added up the numbers. See Schedule F- Creditors Holding Unsecured Nonpriority Claims, the amount I claimed in the bankruptcy is $24,258.10.When I claimed the bankruptcy in 2006, due to my divorce, I made calls to F&M bank about not receiving the paper bill, it was then I was told I did not reaffirm the loan, in which I said I know I had since it was my property and I live on it. I was told that the bills were going to Scott Mallicoat who is my ex-husband. He was not allowed to speak with me due to a protective order on him. Nor would he give me the bills. I then asked if they would please send the bill in his name to my address so I could make sure it was paid. I was told no. Then in 2007 I received letters that the loan was not being paid and was going to foreclosure. I gathered up $3,450.00 to save the home. At that time I was understood to believe that F&M bank did not was to pay off the first mortgage to Wa Mu. That the foreclosure was stopped, and I had brought the loan current with the $3,450.00.Scott knew I saved the house and I didn’t hear anything from anyone. I thought that he was taking care of the loan, until he called me and said “you are going to lose your house!” I then called Diane Millard and asked to work this out before it went to court again since it was only behind $418.00, to save me money on court cost and the chance of losing the home, she said she would talk to her supervisor. Then I got served that week foreclosure papers. I called her again and was told it was out of her hands that someone else had the file. I then had no choice but to call the Attorney General Tom Miller’s mortgage hotline for help to resolve this error. Because I am permantly disabled with 3 kids and have done everything in my power to keep our home, that was built for me after my car accident.Then yesterday my attorney calls and tells me, that I have lost the house, but that the judge was in question of the bankruptcy not reaffirming the loan. That is why I got the papers out and found nothing makes sense. I have 6 months to resolve this or move out. I am so upset about this especially since it was over $418.00. In fairness to me, I feel I was mis-lead about my bankruptcy, not knowing until this time that I did reaffirm the 2nd mortgage and would of kept up with the loan if the communication would have been kept open with me.Karla, my mediation helper did fax my income information to Steve Blackman on August 11, 2008.Please look over the bankruptcy papers. I am more than willing to resolve all the issues. Thank you for your time.Sincerely, Now, Mary wants to work with me, but she wants $3,000.00 plus attorney fees. My ex-husband got the bill yesterday and it is only $1,000.00. I am very upset that she wants me to pay all this money when it was their error. For the past 3 years I have gone back and forth with this bank and want some advice as to what is reasonable to fix this issue. |
