Second Mortgage Help

hello to all this is a great site i have been reading it for the past few nights and love it ....

i have 2 mortgages , the first one i was behind on my first as well as my second mtge , i did a loan mod with the first litton ,the second was a 50k at 15% from a private party with a 5 year ballon the 5 years is up may 5 08 i have not made a payment on that for 11 months they came after me with a law firm in long island that does foreclosures for large banks.

can they take the house from me and how can i stop them ,i have sent a qwr to them and to their lawyer , and the lawyer sent a letter telling me they are not the bank .

so if they do not contact me what can i do ?? i have asked for a reinstatement and also have received no answers to that ,please tell me what powers a second has and how to deal with private lenders (hard money lenders }thank you
