Signature's forged by broker!!!! About one year ago I was contacted by telephone(telemarketer) from a gentlemen who stated he was a broker from Liberty One Financial who was located in Thousand Oaks, California, he asked me if my current mortgage loan was at a adjustable rate, I replied 'yes', he then continued to inform me that in 2 months the interest rates are going to skyrocket for people with adjustable rates, they are going to be left with monthly mortgage payments that they cannot afford to pay, at the moment my adjustable interest only loan had already jumped up 500.00 dollars, so with the info he just gave me I had to do something fast before my monthly mortgage payment will soon double also with no way possible of being able to afford my scheduled rate increase.This guy's name was Layne Nocera, he then proceeded to inform me his company could offer me a 40 yr fixed rate (principal and interest) that would also be impounded, and best of all my monthly would be lower than I was currently paying. So with all taken in I decided to proceed with a refinance through Liberty One Financial. So believe it or not everything was going through as planned I met Mr Nocera at my residence on 2 separate occasions to keep me up to date on progress, on the 2nd visit was now the actual signing of loan docs by me and my wife, what struck me kinda of odd was there was no notary public present it was just Mr Nocera all alone so having dealt with past refinances we always signed them in front of a notary, so when I asked him is he also a notary he implied YES so the signing came to an end I implied ok now where are my copies? he stated that I will recieve them in a couple of days so vulnerable me didn't push the issue. So 1 month went by and I was able to skip a monthly mortgage payment as usual, but upon arrival of my monthly statement it was 200.00 dollars more than what we agreed to and what we had signed to,so I contacted the lender who was countrywide and requested to have my loan documents sent to me since I did never recieve them a couple of days after the sighning like Mr Nocera promised me. Countrywide agreed to have my loan docs sent to me. so with all the hustle and bustle of every day city living we continued to pay our 2600.00 monthly payment as scheduled. So 2007 had passed and now we were in feb 2008 and I recieve a letter from my home fire hazzard insurance yearly premium was now due,so in amazement I called my agent from state farm to explain there must be some type of confusion because I had a impound account, she was not in at the moment so I left a detailed message on her voicemail. 2 days had passed and still no return phone call so when i was attempting to place another call to state farm my other line had a call waiting for me, it was my wife at home crying to me that we recieved a letter from the county assessors office informing me that our property taxes were now delinquient and that a lien would be placed on my property in 14 days if these taxes were not payed so the knife had just been dug a little deeper I couldn't believe it apparently our loan was not impounded like we agreed and signed to was told to us by countrywide upon me contacting them in a panic, I also again requested my loan docs for the 2nd time from them they promised methat they will send them overnight through fedex. We did recieve them as promised from countrywide but upon reviewing them we noticed many,many,many pages in these documents contained signatures and initials that were not ours it was so bad that on a couple of pages my signature was missing letters to my name, OH MY GOD. SO countrywide agreed to pay 7000.00 for my property taxes which did include 1000.00 in penalties and launch theyre own investigation into possible fraud, oh yeh let me also add that my monthly mortgage payment will be now 3900.00 I proceeded to explain that there is no way possible for me to make that payment whatsoever. they told me that once the investigation is concluded I will be able to contact the home retention dept and they would be able to work with me on lowering my monthly. They stated that the investigation usually takes about 1 month, so by the grace of god I was able to pay my monthly, and to no prevail countrywide still has not got back to me regarding the investigation, also before I forget on my loan docs there was a page that had a notary public name on it claiming that we appeared in front of him at signing but the truth will come forward for the simple fact that we never gave thumbprints or signatures in his log book as required by law. Well i finally recieved a call from countrywide notifying me that everything looked in order on their end so that we would have to go after the 3rd party broker involved who is nowhere to be found along with Liberty One Financial his company he works for, ALSO MAKE A NOTE THAT THE UNDERWRITER FROM COUNTRYWIDE WHO FUNDED THIS FRAUDJULANT LOAN IS NO LONGER EMPLOYED WITH COUNTRYWIDE (WHAT A COINCIDENCE) FOR REASONS NOT ABLE TO BE RELEASED TO ME.So now i'm not in default but tittering on the edge of it happening. any lawyers out there who could possibly represent me, I truely believe a crime has been committed against me and my livelyhood (please help) Thank You Michael and Stephanie Armijo |
