Default Question About Escrow Title Charges On Judgements

Ok In 2005 I Refinanced With A Private Lender.

My Loan Was For 260,000 The Loan Origination Fee Was 18,200. Is That Of Consiquence?then Under Title Charges There's A Line That Says Sears 3,541.98.i Know What It Is It's A Judgement That Was Supposed To Be Paid Off Through Escrow Right?

so I Go To Look At My Original Contract From When I Refinanced With Fremont In 2006 And Under The Lenders Special Contingencies It Says "title Sup To Delete Item #4, #6 Judgement Or Pay Thur Escrow".

So Why Was It Never Payed Off?it Is Still On My Credit Report Along With Many Other Debts That Were Supposed To Be Paid Off. My Question Is Can Both Lenders Get In Trouble For This?
