Strange loan from strange lender, broker, and lawyers I bought a house in Providence, RI in July 2005 for $365,000 and now is valued (zillow) at approx $303,000. I must admit i was quiet naive during the whole process, I was 22 years old, had just graduated college and I was approached by this broker to get this home. This loan was originally through US lenders network, is an 80/20. The broker told me she could get me the loan, and until the last week before the closing, she couldnt and she came up with another loan application, etc. I had less then a year of work time, the broker put 2 years in the application, she had her "assistant" complete the land lord information section. After all somehow, I was approved..this loan is 7.75% (80% part of it) and the 20% part of is at 12.05%, is an ARM adjustable with 361 payments, with the last payment being a "lump sum" of $200k++. In the middle of 2006 US lenders network, sent me a letter from the audit deparment, b/c my loan documentation was "off and wrong" b/c they called my company and confirmed that I had only been there for a year not two as the broker had written. I called the broker when I recieved this letter, and she was quiet worry about this. For her good fortune, Lenders network went bankrupt and they never followed up on this issue. Now, the new servicing company is America servicing company, I have read a lot of bad things about them, and I guess i need to get ready for a battle. I have never been late on my loan, it will reset this August and I am very worry that I will loose the property. I really want to keep it, I have looked into refinancing the home, but I am under almost $65,000 and I can not come up with the difference from LTV to refinance it. Is there anything I can do legally, to possibly cancel this loan? How can I try to modify this loan? I need a complete modification, from 361 payments with that lump sum of over $200k to a fully amortized loan with 360 payments and a fixed rate? Is this possible? Also, I feel completed cheated on this loan, I need to read the documents, but i remember a page in which asked if I had recieved conseling on this loan, and he (the lawyer aka..a friend of the broker i found out now) told me.."is just another page here, sign and lets continue with the signatures" HELP! Should I let go of this and move on? I am 24 right now, how long will this stay on my credit? |
